We take pride in presenting our luxury silk pieces with absolute fidelity. However, as silk possesses natural luster and color displays vary across screens, we cannot guarantee that your monitor’s display of any hue will perfectly mirror the physical piece.

All product descriptions, material specifications, and pricing are subject to change at any time without prior notice at our discretion. We reserve the right to limit sales quantities or discontinue products as needed.

Section 3 – Orders and Acceptance

Placing an order constitutes an offer to purchase. An order is deemed accepted only once payment is verified and you receive an official order confirmation email from us.

We reserve the right to decline, adjust, or cancel orders at our sole discretion (for instance, in cases of suspected unauthorized or fraudulent transactions). Any returns or exchanges are governed by our Refund Policy. Products purchased are intended solely for personal, household use and not for unauthorized commercial resale.

Section 4 – Pricing, Payment, and Billing

All prices are quoted in the displayed currency and are subject to change without notice. Delivery costs, statutory VAT (where applicable), and potential import customs duties for deliveries outside Switzerland are detailed during checkout or billed by the relevant customs authority.

Delivery timelines provided on our website or checkout are realistic estimates and not binding guarantees. We partner with reliable carriers, but cannot be held responsible for carrier delays, force majeure events, or customs holds.

In accordance with Swiss law, benefit and risk (Nutzen und Gefahr) regarding the purchased goods pass to the customer upon dispatch or transfer to the shipping carrier.

Section 6 – Intellectual Property

The CÆLO brand, visual assets, copy, product imagery, packaging designs, logomarks, and website architecture are the exclusive intellectual property of CÆLO, protected by copyright, trademark, and unfair competition laws.

Any reproduction, extraction, modification, or commercial exploitation of any site content without our prior express written permission is strictly prohibited.

Our store is hosted on Shopify Inc., which provides the technical e-commerce platform powering our services. Any sales contracts, guarantees, and product commitments are formed exclusively between you and CÆLO.

Section 9 – Data Protection and Privacy

We handle your personal data in accordance with our Privacy Policy and the revised Swiss Federal Act on Data Protection (nFADP / DSG). Because our shop runs on Shopify, certain technical, payment, and order information is processed by Shopify in compliance with their Shopify Privacy Policy.

Section 10 – User Feedback and Submissions

If you submit product reviews, suggestions, or creative feedback, you grant CÆLO a non-exclusive, royalty-free, perpetual right to utilize, edit, publish, or share that content across our channels. We remain under no obligation to compensate you or keep unsolicited ideas confidential.

You may use this website only for legitimate, lawful shopping activities. You agree not to transmit malicious code, scrape content, bypass access barriers, or deploy automated bots/agents that mimic human behavior, obscure their identity, or circumvent security measures.

To the maximum extent permitted by Swiss law (specifically Art. 100 of the Swiss Code of Obligations):

CÆLO disclaims all liability for indirect, incidental, punitive, or consequential damages (including loss of profits or loss of data) arising from your use of the website or purchased goods.
Nothing in these Terms limits or excludes liability for intentional wrongdoing (Absicht) or gross negligence (grobe Fahrlässigkeit), or mandatory statutory liability for defective products under the Swiss Product Liability Act (Produktehaftpflichtgesetz).

Should any provision of these Terms be deemed invalid, unlawful, or unenforceable under applicable law, such provision shall be severed without affecting the validity and enforceability of the remaining provisions.

Section 14 – Governing Law and Jurisdiction

These Terms of Service, all purchase contracts, and any disputes arising out of or in connection with them shall be governed exclusively by the substantive laws of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.

The exclusive place of jurisdiction for all disputes shall be the ordinary courts at the registered seat of CÆLO in Zurich, Switzerland, subject to any mandatory statutory venues provided by law for consumer disputes.
